Mercury Freight Systems LLC (“Mercury Freight,” “we,” “us,” or “our”) respects the privacy of the drivers, customers, and visitors who interact with our company. This Privacy Policy explains what information we collect, how we use it, and the choices available to you, with particular emphasis on how we handle mobile phone numbers and SMS communications.

Information We Collect

We collect the minimum information needed to operate our trucking business and to communicate with drivers, owner-operators, shippers, and brokers. The information we collect may include:

  • Full name and contact details (phone number, email, mailing address)
  • Employment, licensing, and driving-history information submitted through the FMCSA employment application
  • Shipment, dispatch, and load details from customers and brokers
  • Routine operational records (e.g., load confirmations, delivery status)

How We Use Information

We use the information we collect for legitimate business purposes, including:

  • Reviewing driver and owner-operator applications and verifying qualifications
  • Coordinating dispatch, load assignments, and delivery communications
  • Sending SMS customer care messages (to numbers that have opted in — see below)
  • Responding to inquiries and providing customer support
  • Meeting legal, safety, and regulatory obligations (e.g., FMCSA, DOT)

SMS & Mobile Communications

By opting in to receive SMS messages from Mercury Freight Systems, you agree to receive customer care messages. Key terms of the program:

  • No third-party sharing. No mobile information will be shared with third parties for marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
  • Message types. Customer care messages only. No marketing messages.
  • Message frequency. Message frequency may vary. On average, 1-2 messages per month.
  • Message and data rates may apply. Standard carrier charges from your mobile provider apply to all messages sent and received.
  • Opt-out. You can reply STOP at any time to unsubscribe from SMS messages.
  • Help. Reply HELP for assistance, or contact us at 813-530-5555 or management@mercuryfreights.com.

Sender identification. All SMS messages sent under this program will identify the sender as Mercury Freight Systems LLC.

Website numbers are voice-only. The mobile numbers collected through the website will only be used for phone calls, NO SMS. Submitting a phone number through the website does not by itself enroll you in the SMS program. Enrollment in our SMS customer care program happens separately through an explicit verbal opt-in captured by Mercury Freight staff.

Verbal SMS Opt-In Disclosure

When a driver, owner-operator, or customer provides their mobile number to Mercury Freight staff, they are read (or provided with) the following disclosure before enrollment:

“By opting in to receive SMS messages from Mercury Freight Systems, you agree to receive customer care messages. Message frequency may vary; on average, 1-2 messages per month. Message and data rates may apply. No mobile information will be shared with third parties for marketing purposes. Reply STOP to unsubscribe at any time or HELP for assistance, or contact Mercury Freight Systems LLC. Data Sharing Restrictions

Your data will not be transferred to external organizations. This includes consumer data, mobile numbers, and SMS consent data. Such information will only be disclosed when legally required.

No Marketing Sharing

Consumer consent does not permit the sharing of consumer data, mobile numbers, or SMS consent data with external organizations for marketing purposes.

Safeguards Against Unauthorized Sharing

  • Access to consumer data is limited through appropriate access controls.
  • Personnel with access to such data are subject to confidentiality obligations.
  • Security measures are maintained to protect consumer data, mobile numbers, and SMS consent data from unauthorized access, use, or disclosure.

Data Sharing & Disclosure

We do not sell personal information. We do not share mobile numbers or SMS opt-in data with third parties or affiliates for marketing or promotional purposes. We may disclose information only in the following limited circumstances:

  • To vetted service providers (e.g., dispatch, messaging, and payroll platforms) who process information on our behalf under confidentiality obligations
  • To shippers, brokers, or consignees where necessary to complete a load
  • To comply with applicable laws, regulations, subpoenas, or lawful requests from government authorities (including FMCSA and DOT)
  • To protect the rights, property, or safety of Mercury Freight, our drivers, our customers, or the public

Data Retention

We retain information for as long as it is needed to operate our business, fulfill the purposes described in this policy, and meet legal or regulatory record-keeping requirements. When information is no longer required, we securely delete or de-identify it.

Your Choices

  • Reply STOP to any SMS message to unsubscribe from our SMS program.
  • Reply HELP to any SMS message, or contact us directly, for assistance.
  • Contact us to request access to or correction of information we hold about you.
